- Even without the special situation resulting from the ongoing COVID-19 pandemic, new working models, such as mobile working or teleworking in the form of home offices, are increasingly coming into focus. The crisis may accelerate the considerations on the part of the employers, but above all the ongoing digitalisation, high rental costs in the metropolitan areas, the recruitment of highly-skilled workers as well as environmental and work-life-balance aspects play a major role in the development of new forms of work. This article examines the tax consequences of working in a home office and attempts to answer the question of whether the home office constitutes a permanent establishment under tax treaty law
