Summary
This article explains what additional information HMRC can obtain from medical records under the terms of the tax health plan (THP) disclosure facility. It is known that HMRC has collected a large amount of data on monies paid by the National Health Service, private hospitals and insurance companies, which is expected to be used in relation to those medical professionals who have not registered an intention to make a disclosure by 31 March 2010. This article considers balancing HMRC's information needs with human rights, the PACE definition of 'personal records', when HMRC might want to see medical records, whether the 'Compliance Handbook' is misleading, and when a patient's identity can be covered up
