Part four of the Treaty on the Functioning of the European Union and Council Decision 2001/822/EC contain provisions that regulate the terms of the association of the Member States with so-called "overseas countries and territories" whose ranks include the Cayman Islands, the British Virgin Islands and the Netherlands Antilles. This article deals with these provisions. It considers their effects and, in particular, whether they create freedom of establishment rights in relation to companies incorporated in one of the overseas countries and territories. The author includes an analysis of the Court's recent Prunus decision
