For decades, many American, and recently also some European, artists have used private foundations to protect and promote their aesthetic legacies. The rapid rise in both the number of such foundations, and the multimillion dollar lawsuits by or against them, is proof of the need of a comprehensive review that must consider the many competing interests. This article highlights only some of the conflicts that the existing legal literature either has ignored or has merely given lip service. It addresses also various practical - and sometimes surprising - problems that an artist can leave for a survivor. The article also looks at some tax aspects
