- On 3 July 2016, the president of Russia signed into law VAT bill No. 244 which introduces the concept of "services provided through the Internet" or electronically supplied services (ESS) and amends the Russian place-of-supply rules for VAT purposes accordingly. The Law comes into effect on 1 January 2017, and reshapes the economics for electronic services provided by nonresident companies to Russian customers in the business-to-business (B2B) and business-to-consumer (B2C) segments, both with and without involvement of foreign intermediaries, such as aggregators and payment agents. This article first summarizes the existing place of supply rules for VAT purposes, the Russia-specific VAT exemption for software use licenses and related key court cases. In addition, the article addresses the scope of the VAT Bill, lists the types of electronic services covered by the Law, describes the VAT payment and reporting procedure and potential direct tax risks
