Summary
Judgment by the Singapore High Court dated 30 June 2008. The day before the UK company Relfo placed itself in liquidation its directors had passed all the company's assets to an overseas bank and the following day an almost equivalent sum of money had appeared in the defendant's account in another overseas bank. The liquidator appointed by the Inland Revenue pursued the defendant alleging knowing receipt. It was held that there was a prima facie case of knowing receipt, but that the action was an attempt indirectly to enforce a foreign tax debt (due to the United Kingdom), and therefore the claim was dismissed. This is a strict application of the traditional revenue rule of non-assistance in the enforcement of foreign taxes
