Summary
Judgment by the Supreme Court of Ireland, judgment date 12 March 2018. Mr O'Connor was convicted in the UK of tax fraud. While on bail, he absconded to the Republic Ireland. The UK court sentenced him to four years imprisonment and a European Arrest Warrant was issued. Mr O'Connor was detained by the Irish authorities. He contested surrender under the European Arrest Warrant on the ground that his term of imprisonment would extend beyond the date on which the UK was scheduled to leave EU and that he would lose the right to have any dispute as to his rights under EU law. The Irish Supreme Court was uncertain whether in those circumstances he could be returned to the UK under the warrant and has sent questions to the European Court of Justice for a preliminary ruling
