Summary
The U.S, has experienced recent growth in the number of medical marijuana dispensaties and a commensurate rapid increase in dollar volume of medical marijuana sales. These dispensaries are now legal in 14 states, and there are thought to be thousands of these businesses operating in the U.S. This article examines the general tax reporting for businesses enganged in illegal activities including the development and codification of the public policy doctrine that led to the introduction of Section 280E, the unique intersection of state and federal tax law for medical marijuana dispensaties, and professional practice issues associated with CPAs providing services to taxpayers caught in this crossfire
