The USA is among only two countries worldwide that impose a tax on the worldwide income of its citizens and lawful permanent residents. Recently, the information reporting and regulatory environment with respect to such US persons has expanded significantly, particularly with the enactment of the Foreign Account Tax Compliance Act (FATCA). Each year, an ever-increasing number of individuals decide to expatriate, or formally renounce their status as US citizens or lawful permanent residents. The process of expatriating is relatively straightforward. However, for most individuals, meaningful planning can, and should, be conducted prior to expatriating to ensure an optimal result. Failure to consider all of the issues in advance of one's expatriation may cause unexpected and adverse consequences that could have been avoided or minimized with proper planning.
