The Indian government issued Circular No.01/2013 [F. No. 5(1)/2013-FC.I, 5 April 2013, Department of Industrial Policy and Promotion], setting out a new foreign direct investment (FDI) policy, which is effective from 5 April 2013. The Circular subsumes and supersedes all press notes, press releases, clarifications, and other circulars issued by the Department of Industrial Policy and Promotion that were in force before 5 April 2013. Notwithstanding the rescission of this earlier guidance, any action taken or purported to have been taken under those releases prior to 5 April 2013, will, insofar as not inconsistent, be deemed to have been taken under the corresponding provisions of the new Circular and will be valid and effective. The FDI policy may be updated every year to capture and keep pace with regulatory changes. This article discusses Chapter 3, which contains general conditions on FDI
