Summary
This article investigates the identification of "residential" premises in Subdiv 40-C of the A New Tax System (Goods and Services Tax) Act 1999 (Cth) (GST Act) for the purposes of applying input taxed treatment. In particular, this article considers the most appropriate approach to be used in an Australian context when distinguishing (or eliminating the need to distinguish) between input taxed residential premises and other taxable real property. This investigation is conducted with reference to: the Australian GST rules currently in place to identify residential premises; the GST rules currently in place in selected comparable jurisdictions, i.e. New Zealand and the European Union, in relation to the GST/value added tax (VAT) treatment of residential premises; the policy framework (including policy objectives) within which the Australian and international GST/VAT rules were developed; and the approaches used or proposed to be used to identify (or avoid the need to identify) residential premises for GST/VAT purposes. The preferred approach is determined by reference to the five generally accepted tax design principles of equity/neutrality, efficiency, simplicity (in particular, the status of Australia's GST as a "practical business tax"), sustainability, and policy consistency (i.e. with the policy objectives identified)
