Mergers and acquisitions by multinational companies require attention to foreign investment controls around the world. For more than a decade, the Committee on Foreign Investment in the United States (CFIUS) has been and remains top of mind for non-US companies looking to invest in the United States. Many other countries also have established similar, national-security-focused foreign investment controls, while other countries impose controls focused on other issues. These controls are increasingly more important due to the global nature of many corporate transactions, which often involve subsidiaries and affiliates located around the world. This article surveys the current foreign investment control regimes, as well as certain potential significant changes on the horizon, in more than fifteen major jurisdictions
