On 7 April 2005 Advocate General Poiares Maduro delivered his opinion in Marks & Spencer plc v Halsey (case C-466/03). It is to the effect that the UK's rules on group relief are, in the terms in which they are written, contrary to the EC Treaty. But despite that, according to the author, the opinion fails to tell the parties to the litigation what they most want to know: i.e. which of them is winning
