- In late 2003, the German Federal Tax Court ruled that, on the basis of non-discrimination clauses under tax treaties, a Delaware company with legal seat in the US can be the fiscal unity parent of a German company. The tax authorities decided to partly apply the decision. Using the decision as a starting point the article discusses the interpretation of non-discrimination clauses under tax treaties and under EU Law
