Canadians unfamiliar with the U.S. income tax system are often surprised when they first learn that its reach extends far beyond the U.S. border. Even those Canadians who were aware of this broad reach may have been amazed by its further and elaborate extension under the Foreign Account Tax Compliance Act (FATCA), which was passed over a year ago as part of the HIRE Act, with an effective date delayed until 1 January 2013. When implemented, FATCA will impose substantial additional disclosure, reporting, and withholding obligations on traditional withholding agents, foreign financial intermediaries, funds, and foreign corporations, partnerships, and trusts. This article discusses FATCA's background, FATCA's provisions, and interaction with treaties
